Depending on the nature of your work first consider if you need to keep information under the Health Act, if not then the Privacy Act applies. We look forward to exploring this in more detail with members in 2021.

Privacy Act Note Principal 5 and 9 
 
When the Privacy Act doesn’t apply:
  • If another law is inconsistent with the Privacy Act, that other law will override the general provisions of the Privacy Act.
  • People who collect or hold personal information for their own personal or household affairs are exempt. This exemption does not apply if the information is highly offensive.
  • In special circumstances, the Commissioner can authorise agencies to collect, use or disclose information even when that would usually breach the privacy principles.
